A former employee at the Radio Shack in Corte Madera is charged with stealing racy personal photos off a customer’s cellphone.
Jose Robert Miranda, 24, of Richmond is scheduled to be arraigned Monday in Marin Superior Court. He is free on bail.
Miranda and Radio Shack have also been named as defendants in a civil lawsuit by the alleged victim, a 28-year-old San Francisco woman.
The woman says she brought the phone to the Radio Shack in November to get its broken glass repaired. On Jan. 8, she was deleting photos from her tablet, which is connected to her call phone through iCloud, when she realized 17 of her photos had been texted to an unfamiliar phone number.
“The photographs in question were of a private and sensitive nature and depicted the Plaintiff wearing little or no clothing,” her attorney, Timothy Osborn of Bakersfield, wrote in the lawsuit.
The woman reported the allegations to the Central Marin Police Authority. Police identified the employee who handled the phone as Miranda.
“He basically admitted to stealing these photographs and sending them to himself,” said Central Marin police Sgt. Paul Barrolaza.
Miranda was arrested and posted bail while prosecutors reviewed the case. On Thursday, Miranda was charged with stealing computer data, a felony, and a related misdemeanor, said Deputy District Attorney Shawn Spaulding.
Miranda no longer works at the Radio Shack, which is at 139 Corte Madera Town Center. A manager there referred questions to a corporate media relations department, which did not respond to an email and a phone request for comment.
Miranda could not be reached for comment.
The lawsuit, which does not name the accuser, seeks unspecified damages on allegations of privacy intrusion, negligence and other causes of action.
